BIBLE LAW VS. THE UNITED STATES CONSTITUTION:
The Christian Perspective
If you are a Libertarian, you scarcely believe in any law whatsoever, and therefore the Psalmist’s assertions have little or no relevance to you – or so you think.
If you are a Democrat, you do not even make a claim to believe any of these declarations – unless, of course, you are running for public office and think doing so will secure votes for you.
If you are a Republican, you do not really believe any of these statements.
If you are a Christian4 Constitutionalist, you may claim you believe the Psalmist’s statements, but judging by your actions – particularly your allegiance to the United States Constitution – you do not believe Psalm 19:7-9 anymore than do the Libertarians, Democrats, and Republicans.
Anyone who believes Yahweh’s law is perfect will distance himself from these and any other political parties that represent anything other than Yahweh’s commandments, statutes, and judgments, and they will refuse to vote for their candidates. (See Chapter Five “Article 2: Executive Usurpation” for additional information regarding the unbiblical nature of elections.) The man who believes Psalm 19:7-9 will pursue Yahweh’s law – His government here on earth as it is in heaven – to prepare the way for future generations to experience Yahweh’s kingdom to its fullest.
Although some people will be offended, it must be said: Christian Constitutionalists are just as much idolaters as are Republicans, Democrats, and Libertarians, and the Pharisees whom Jesus5 denounced:
This people draweth nigh unto me with their mouth, and honoureth me with their lips; but their heart is far from me. But in vain they do worship me, teaching for doctrines the commandments of men. (Matthew 15:8-9)
If a person elevates the commandments of men as doctrine, or canon, his heart does not belong to Christ. The Constitution is a compilation of the commandments of men. It is not inspired Scripture, and it is antithetical to Yahweh’s law in nearly every article and amendment. The “Christian” faith of those who promote it is in vain:
And they come unto thee [Yahweh] as the people cometh, and they sit before thee as my people, and they hear thy words, but they will not do them: for with their mouth they shew much love, but their heart goeth after their covetousness [their own desire]. (Ezekiel 33:31)
Many people claim they love Yahweh, but their actions prove otherwise:
If ye love me [Jesus], keep my commandments. (John 14:15)
For this is the love of God, that we keep his commandments…. (1 John 5:3)
We cannot claim to keep Yahweh’s commandments while promoting a national covenant antagonistic to those same commandments. How dare we think He will accept our obedience to man’s law as evidence of our love for Him? As finite beings, we are not free to dictate to Yahweh where and when His moral laws are and are not to be observed. The previous two passages apply to every sphere of our existence, not just our personal lives. Any sphere in which we are not applying Yahweh’s law is indicative of our rebellion and is doomed to fail:
Except YHWH build the house, they labour in vain that build it…. (Psalm 127:1)
Unless we are laboring to build Yahweh’s house – a government of, by, and for Him – our labor is futile:
…This people say, The time is not come, the time that YHWH’s house should be built. Then came the word of YHWH … Is it time for you, O ye, to dwell in your ceiled [paneled, NASB] houses [our own, the White House, the House of Representatives, or the Senate], and this house lie waste? …Consider your ways. Ye have sown much, and bring in little … he that earneth wages earneth wages to put it into a bag with holes…. Go … and build the house; and I will take pleasure in it, and I will be glorified, saith YHWH. Ye looked for much, and, lo, it came to little; and when ye brought it home, I did blow upon it [blow it away, NASB]. Why?... Because of mine house that is waste, and ye run every man unto his own house. (Haggai 1:2-9)
History has proven that, according to Biblical standards, the efforts of those who labored to build a government of, by, and for the people have been in vain:
Notwithstanding they would not hear, but hardened their necks, like to the neck of their fathers, that did not believe in YHWH their God. And they rejected His statutes, and his covenant that he made with their fathers, and his testimonies which He testified against them; and they followed vanity, and became vain…. (2 Kings 17:14-15)
Nothing demonstrates the superiority of Yahweh’s government better than contrasting it with man-made government. Regrettably, because most Christians are merely waiting to go to heaven, they have been duped into believing government affairs are none of their concern. They take the stance that because government is “of the world,” they should not concern themselves with it. The United States government is most certainly of the world because Christianity abdicated rule to the non-Christians and antichrists. We have exchanged Yahweh’s law and morality for man’s lawlessness and immorality. We have handed over the kingdom for less than a mess of pottage.
This hands-off government policy of today’s Christians is a relatively new phenomenon. The first-century apostles and disciples certainly did not take this same approach, as demonstrated in Acts 17:6-7, Romans 13:1-7, 1 Corinthians 6:1-5, 2 Corinthians 10:6, 1 Timothy 1:8-11, etc. Nor was this the approach taken by most of America’s Christians in the 1600s and early 1700s. King George detested America’s pre-Revolutionary War ministers for their interference in government affairs so much that he attempted to replace them with his own Episcopal lackeys – the early version of the 501(c)(3) government-issued preachers of today. If a government is transgressing Yahweh’s law, those running it will not want preachers around pointing out their lawlessness and creating a disgruntled populace. What better way to constrain and control preachers than to convince them government affairs are none of their business?
Because most of today’s Christians have yet to fully comprehend the responsibilities that come with being the light of the world and the salt of the earth, the government has been able to muzzle most preachers by licensing them. He who provides the license also provides the rules of conduct. Even if preachers were to awaken from their slumber, the government would be able to control most of them by threatening to revoke their tax-exempt status. Whatever entity provides exemption is the jurisdictional god of what it exempts.6 Churches must rescind the 501(c)(3) tax-exempt status that makes them subservient to the government instead of Yahweh. Until then, today’s churches, preachers, and Christians will only add sin to sin:
Woe to the rebellious children, saith YHWH, that take counsel, but not of me; and that cover with a covering, but not of my spirit, that they may add sin to sin. …this is a rebellious people, lying children, children that will not hear the law of YHWH. (Isaiah 30:1, 9)
The word “cover,” in the phrase “cover with a covering,” is translated from the Hebrew word nacak. Some Bible versions translate it “treaties” and “alliances,” words not far removed from “covenants” and “constitutions.” James Strong’s definition of nacak is even more interesting:
…a primitive root; to pour out, especially a libation, or to cast (metal); by analogy, to anoint a king.7
In 1 Samuel 12, the people recognized they had added to their sins by asking for a king (a surrogate covering):
And all the people said unto Samuel, Pray for thy servants unto YHWH thy God, that we die not for we have added unto all our sins this evil, to ask us a king. (1 Samuel 12:19)
America is in the same position today. She has added to her sin by enthroning another god: WE THE PEOPLE. (See Chapter Three “The Preamble: WE THE PEOPLE vs. YAHWEH” for proof that WE THE PEOPLE is indeed a god.)
In addition to rejecting Psalm 19:7-9, Constitutionalists also fail to believe the Prophet Isaiah’s affirmation:
For YHWH is our judge, YHWH is our lawgiver, YHWH is our king; he will save us. (Isaiah 33:22)
Yahweh has a monopoly on sovereignty, justice, and legislation – just as much as He does on salvation. Although Christian Constitutionalists may claim they believe this affirmation, in practice, they reject Yahweh as King, Judge, and Lawgiver, just as the Israelites did when they chose a flesh and blood king instead of Yahweh. Tragically, the Israelites desired to be like all the nations around them even though Yahweh had chosen them to be above the other nations:
And YHWH hath avouched thee this day to be his peculiar people [treasured possession, NASB], as he hath promised thee, and that thou shouldest keep all his commandments; and to make thee high above all nations which he hath made, in praise, and in name, and in honour; and that thou mayest be an holy people unto YHWH thy God, as he hath spoken. (Deuteronomy 26:18-19)
Israel’s law observance and Yahweh’s subsequent blessings not only set the Israelites apart from other nations (in the same way 17th-century Christian America was set apart), they were also Yahweh’s witnesses to the rest of the world of the prosperity and blessings that come from serving Him according to His moral laws:
Behold, I have taught you statutes and judgments, even as YHWH my God commanded me, that ye should do so in the land whither ye go to possess it. Keep therefore and do them; for this is your wisdom and your understanding in the sight of the nations, which shall hear all these statutes, and say, Surely this great nation is a wise and understanding people. For what nation is there so great, who hath God so nigh unto them, as YHWH our God is in all things that we call upon him for? And what nation is there so great, that hath statutes and judgments so righteous as all this law, which I set before you this day? (Deuteronomy 4:5-8)
YHWH our God be with us, as he was with our fathers…. That he may incline our hearts unto him, to walk in all his ways, and to keep his commandments, and his statutes, and his judgments, which he commanded our fathers. ...[B]e nigh unto YHWH our God day and night, that he maintain the cause of his servant, and the cause of his people Israel at all times … that all the people of the earth may know that YHWH is God, and that there is none else. (1 Kings 8:57-60)
Proverbs 14:34 declares, “Righteousness exalteth a nation.” Isaiah 24:5 proclaims, “The earth … is defiled … because they have transgressed the laws, changed the ordinance, broken the everlasting covenant.” Under the New Covenant, Yahweh has again chosen a Christian remnant of His people to reign as examples to the rest of the nations. However, Christian Israel,8 as a whole, has rejected this position of honor by rejecting Yahweh as their King, Judge, and Lawgiver. They have lost their privileged status – at least in practice – and have become less than all the nations around them, trampled under the foot of man.
If we hope to reverse this condition, Christian Israel must enthrone Yahweh, not only in their hearts, but also in their homes, their churches, their communities, and eventually in their nations. Enthroning Yahweh requires the pursuit of His law in every sphere of life. If they pursue Yahweh’s laws at all, most Christians, pursue them only in their hearts, homes, and churches. They leave their communities and nations to the non-Christians and to the immoral laws of their gods, including the constitution of WE THE PEOPLE.
Christian Constitutionalists are like the Babylonian King Nebuchadnezzar who, on one hand, proclaimed Yahweh as the God of gods and, on the other hand, erected an image made in his own likeness. What is interesting about this dualism is that most people do not realize they are afflicted with it. Aaron apparently did not realize he was practicing dualism when, in Exodus 32:3-5, he dubbed the golden calf “Yahweh.” A Christian’s devotion cannot be split between Yahweh’s perfect law and man’s law, which are at odds with each other:
Because that, when they knew God, they glorified him not as God, neither were thankful; but became vain in their imaginations, and their foolish heart was darkened. Professing themselves to be wise, they became fools, and changed the glory of the uncorruptible God into an image made like to corruptible man…. Who changed the truth of God into a lie, and worshipped and served the creature more than the Creator, who is blessed for ever. Amen. (Romans 1:21-25)
Romans 1 is a textbook portrayal of what results from a government of, by, and for the people versus a government of, by, and for Yahweh. The claim of Christian Constitutionalism is as oxymoronic as the claim of Judeo-Christianity.9 It is spiritual schizophrenia. The Constitution is almost as antithetical and hostile to Yahweh’s law as is the Babylonian Talmud. As Christians, and therefore subjects of the King of kings, our devotion is due exclusively to Yahweh, His kingdom, and his law. Synonyms of devotion include fidelity, allegiance, ardor, fealty, loyalty, and homage. These are all forms of worship to which Yahweh claims exclusive rights:
For I am jealous for you with a godly jealousy; for I betrothed you to one husband, that to Christ I might present you as a pure virgin. But I am afraid, lest as the serpent deceived Eve by his craftiness, your minds should be led astray from the simplicity and purity of devotion to Christ. (2 Corinthians 11:2-3, NASB)
This betrothal is the fulfillment of Hosea’s prophecy of the return of the ten-tribed house of Israel to Yahweh as His New Covenant bride:
And I will betroth thee unto me for ever; yea, I will betroth thee unto me in righteousness, and in judgment, and in lovingkindness, and in mercies. I will even betroth thee unto me in faithfulness: and thou shalt know YHWH. (Hosea 2:19-20)
This and 1 Corinthians 10:1 identify the Corinthians as descendants of the house of Israel. (See Chapter Two “The Kingdom: Yesterday, Today, and Forever” for additional information regarding Yahweh’s New Covenant marital relationship with Christian Israelites.10) Having betrothed a remnant of Israelites to Himself, whose covenant and law do you suppose Yahweh intends them to keep?
Behold, the days come, saith YHWH, when I will make a new covenant with the house of Israel and with the house of Judah…. For this is the covenant that I will make with the house of Israel after those days, saith YHWH; I will put my laws into their mind, and write them in their hearts: and I will be to them a God, and they shall be to me a people. (Hebrews 8:8-10)
As a virgin espoused to Yahweh, Israel kept His law, but as an idolatrous whore, she kept the laws of her lovers. What are we when we choose some other law in addition to or above Yahweh’s law? To be devoted to a document that is not in accord with Yahweh’s law amounts to rejection of His law, and therefore Yahweh Himself. If the two are in accord – as some Constitutionalists naïvely claim – why do we need the Constitution? Or someone might argue on the same grounds, why do we need the Bible? If the Constitution is consonant with Yahweh’s law, it is both redundant and superfluous. If it is not consonant with Yahweh’s law, the Constitution is treasonous and seditious to Yahweh and His kingdom.
Christian Constitutionalists would have us believe the Constitution was inspired by the Bible. In Pastor Chuck Baldwin’s July 1, 2005, Internet post “Bible Inspired America’s Founding Documents,” he wrote:
The destruction of America’s founding principles can be traced to the country’s willful rejection of the Bible as our source of divine authority.11
I could not agree more: America’s founding principles – not those from the late 1700s, but those from the early 1600s, which were based upon Yahweh’s law – have been destroyed by America’s willful rejection of the Bible. This began officially, nationally, and practically with the ratification of the Constitution. No one would argue that a few Biblical principles can be found in the Constitution. But we also find a plethora of instances in which the Constitution not only conflicts with Biblical laws and principles, but in which it blatantly attacks Yahweh and His exclusive sovereignty and authority.
Baldwin is certainly not the only Constitutionalist who equates the Constitution with the Bible and constitutionalism with Christianity. In response to Alabama’s Court order for Chief Justice Roy Moore to be dismissed from his bench for refusing to remove the Ten Commandments monument erected in front of the Alabama Supreme Court Building, the late Dr. D. James Kennedy paradoxically declared the following:
Today’s action by the Alabama Court of the Judiciary is a deplorable example of why our nation, and most particularly our judicial system needs to return to recognition of God and His law. Unable to discern between the rule of law and a federal court order that violates the rule of law contained in the U.S. Constitution, the Court of the Judiciary has removed Chief Justice Moore.12
Kennedy implied that a return to the Constitution is equivalent to a return to Yahweh and His law. How does Yahweh feel about that? Consider what Yahweh informed the house of Israel before He divorced them:
Israel is an empty vine, he bringeth forth fruit unto himself: according to the multitude of his fruit he hath increased the altars [to idols]; according to the goodness of his land they have made goodly images [sacred pillars, NASB]. Their heart is divided; now shall they be found faulty…. For now they shall say, We have no king, because we feared not YHWH…. (Hosea 10:1-3)
Yahweh declared the Israelites were bringing forth fruit unto themselves. Is this not what “a government of, by, and for the people” does? Since the Constitution was ratified, the idols in America have multiplied a hundredfold. With the ratification of the Constitution, Christian America ceased to exist and a Judeo-Christian America commenced. America quickly became completely polytheistic – one nation under many gods, in violation of the First Commandment “Thou shalt have no other gods besides Me [Yahweh].” (See Chapter Eleven “Amendment 1: Government-Sanctioned Polytheism” for additional information regarding Amendment 1’s seditious provision for polytheism.)
When Christians appeal to both the Bible and a Constitution that is antithetical and antagonistic to Yahweh’s law, how can their hearts not be divided? They no more serve Yahweh as their King than did the Israelites in Hosea’s day:
…the Assyrian shall be his king, because they refused to return. And the sword shall abide on his cities, and shall consume his branches, and devour them, because of their own counsels [because they do what they themselves think best, TEV]. And my people are bent to backsliding from me: though they called them to the most High, none at all would exalt him. (Hosea 11:5-7)
In his editorial “Tom Anderson on Christianity and the Constitution” (in which the word “Constitution” is printed at least four times larger than is the word “Christianity”), Anderson declared our loyalty as Christians is due, not to the moral laws of Yahweh, but to the Constitution:
Some Christians contend that we should support whatever government is in power because it is ordained of God. But our authority, in this greatest of all free Republics, resides not in man, nor even in a majority vote in the Congress or the Supreme Court, but in the Constitution of the United States. It is to the Constitution that we owe our loyalty…. Let us remember that ours is not just America’s battle. Nor our personal battle. It is God’s battle.13
Our loyalty is due only to Yahweh and His law. His battle, and thus His subjects’ battle, is not for constitutionalism, but for His kingdom here on earth as it is in heaven, governed solely by His commandments, statutes, and judgments.
R.J. Rushdoony described the Constitution as “a good procedural manual”14 to be employed by Christian government. But how can something so contrary to Yahweh’s laws be a good procedural manual for those same laws? Gary North, Rushdoony’s son-in-law, commented on this “procedural manual”:
Rushdoony says that the Constitution’s procedural morality can be and is legitimately religiously neutral, and that any interest group can adopt the Constitution’s procedural morality to create whatever law-order they choose, without violating the text of the nation’s covenanting document. But the text is all there is of the underlying religious foundation. If the text were silent, then there would be no formal underpinning. But the text is not silent. The text [Article 6] categorically prohibits the imposition of the biblical covenant oath in civil law. Let us put it covenantally: what the text of the U.S. Constitution prohibits is Christianity.
There can be no dualism in a covenantal document. It either serves the God of the Bible or some other god. There can be no neutrality. Constitutions are inherently substantive, but this ethical foundation is manifested in its procedural stipulations.15
What North described as dualism, the Prophet Daniel depicted as confusion:
O Lord, righteousness belongeth unto thee, but unto us confusion of faces, as at this day…. O Lord, to us belongeth confusion of face, to our kings, to our princes, and to our fathers, because we have sinned against thee…. Neither have we obeyed the voice of YHWH our God, to walk in his laws, which he set before us by his servants the prophets. Yea, all Israel have transgressed thy law, even by departing, that they might not obey thy voice; therefore the curse is poured upon us…. (Daniel 9:7-11)
This is a perfect depiction of the United States Constitutional Republic’s government officials and today’s Constitutionalists. North aptly describes the consequences:
…any attempt to achieve it [neutrality] in covenantal affairs inevitably ends up favoring covenant breakers in their active pursuit of God-defying agendas … and every attempt to implement it judicially works to undermine the kingdom of God.16
Christians must stop serving two masters. We must choose between the document that begins “We the People,” and the one that begins “In the beginning God.” We must choose between a government of, by, and for the people and a government of, by, and for Yahweh. Like Gideon in Judges 6, we must tear down our fathers’ idol and altar before we can restore Yahweh’s kingdom here on earth.
These are the statutes and judgments, which ye shall observe to do in the land, which Yahweh God of thy fathers giveth thee to possess it, all the days that ye live upon the earth. Ye shall utterly destroy all the places, wherein the nations … served their gods, upon the high mountains, and upon the hills, and under every green tree: And ye shall overthrow their altars, and break their pillars, and burn their groves with fire; and ye shall hew down the graven images of their gods, and destroy the names of them out of that place. (Deuteronomy 12:1-3)
Without question, this is a costly decision. It will, at the very least, demand a change in beliefs. It will cost some people their pride. It will cost relationships, perhaps fellowship, and, for some pastors, even their ministries. People may be persecuted.17 However, any cost incurred will be far exceeded by the rewards of choosing correctly: Yahweh’s pleasure and blessings, the legacy we leave our posterity, peace and prosperity, and the foundations for what will ultimately be the near elimination of crime.
If WE THE PEOPLE be God, follow them. But if Yahweh be God, we must follow Him. As for me and my house, we will follow and serve Yahweh as God, King, Judge, and Lawgiver. Everyone who truly believes Yahweh, His kingdom, and His law are perfect and sufficient must do the same – in the life to come and here on earth now.
The night is far spent, the day is at hand: let us therefore cast off the works of darkness…. (Romans 13:12)
